Summary

A newspaper cutting from THE TIMES 1 DECEMBER 1942 A DECREE NISI OF NULLITY In a reserved judgment Mr. JUSTICE PILCHER yesterday granted the husband respondent in a suit a decree nisi of nullity of marriage on the ground that the marriage had not been consummated owing to the wife's incapacity. The wife had filed a petition for judicial separation, alleging that the husband had committed adultery. By his answer the husband alleged that the wife was incapable of consummating the marriage or, alternatively, had willfully refused to consummate the marriage, and asked for a degree of nullity. The marriage took place in May, 1926, and in 1930 a child was born to the wife of whom the husband was admittedly the father. Mr. Beyfus, K.C., and Mr. Holroyd Pearce appeared for the husband; Mr. H.W. Barnard, K.C., and Mr. R.T. Barnard for the wife. MR. JUSTICE PILCHER, in rejecting the wife's plea and pronouncing a decree nisi of nullity on behalf of the husband, said that there was nothing in the medical evidence to preclude him from accepting the husbands evidence. He held that the marriage had not been consummated, either before or after the birth of the child, by reason of the wife's incapacity. Solicitors.---- Messrs. Kenneth Brown, Baker, Baker; Messrs.
